This Agreement commands the use of Kolaxo Instruments, its directory websites, and all services linked to the websites (collectively, the “Sites”), which are possessed and operated by Kolaxo Instruments Inc. (“Kolaxo Instruments”, “our”, “us”, “we”), the lawful owner of the Sites. To use or access the Sites, you are agreeing to conform and guaranteed to follow this Agreement’s terms and conditions. If you disagree with the Agreement’s terms and conditions, you are unable to use the Sites.
This Agreement may also be modified by us at any time. We will notify you of our amendments to the terms and conditions of this Agreement. Your acknowledgment will indicate that you agree to the amended terms and continue to use the Site. The latest Agreement with amended terms and conditions will be posted on the websites, and you should read the Agreement before using the Sites. We may also cease the Sites or some parts of the Sites at any time without giving any notice. Moreover, we reserve the absolute and sole discretion and right to revoke, deny, or constrain access to any user that at any time violates the terms and conditions of this Agreement, including the right to restrict access from a specific Internet address to the Sites.
We are devoted to shielding the privacy of the children. The Sites are not envisioned or directed to children below the age of 16. If you are under the age of 16, do not use the Sites and do not give your personal details to Kolaxo Instruments. To use the Sites, you need a permit that you are at least 16.
You admit that the Sites contain photographs, information, video clips, audio clips, software, images, text, designs, graphics, illustrations, links, icons, and content developed by Kolaxo Instruments for you and also the materials that are protected by trademark, copyright, and proprietary rights of Kolaxo Instruments or third parties, such as product name, designs, titles, logos, and phrases or words which may be recorded in certain authorities (Collectively, the “Kolaxo Instruments Content”). As between you and Kolaxo Instruments, all titles, rights, and interests in and to Kolaxo Instruments Content will belong to Kolaxo Instruments. And you will have no same rights and limited rights to access. As a whole, the Sites are secured by trade dress and copyright, title, and all worldwide rights and are owned by Kolaxo Instruments.
The phrase “KolaxoInstruments” is a trademark owned by Kolaxo Instruments. Other trademarks and trade names exist on the Sites shown with the consent of their owners. It appears under the “fair use” principles. We do not intend endorsement or suggestion of the third party, its products, or services by using the third party’s trade name or trademark. We disclaim any type of endorsement and affiliation.
You agree to follow with additional information, copyright notices, or restrictions contained in any Kolaxo Instruments Content available on the Sites. Under the principle of “fair use”, users may use the Kolaxo Instruments Content only for their non-commercial and personal use. Kolaxo Instruments may make available through the actual forms and the Site’s sample, other documents (collectively the “Documents”), or checklists. Kolaxo Instruments gives you limited permission and rights to use the Documents for your non-commercial and personal purpose without any right to distribute, sublicense, re-license, transfer or assign such rights. You may not transfer, transmit, modify, publish, sell, create derivative works from, reproduce, display, perform, distribute, or exploit any of the Kolaxo Instruments Content, in parts or in whole, except permitted in this Agreement. No copying, redistribution, publication, or storage of any Kolaxo Instruments Content is permitted without the consent of Kolaxo Instruments, the owners of such Kolaxo Instruments Content, or their legal persons, if other than Kolaxo Instruments. No title, interest in, or right, to any downloaded software or materials is transferred to you in case of copying or downloading.
The site is proposed to be used for legal purposes only. Site Users may have this opportunity to transmit, post, or otherwise make available ideas, information, images, opinions, or other content on the website. You cannot post false, libelous, obscene, pornographic, harassing, abusing, threatening, or defamatory Content on the Sites.
Payment terms are determined for each individual client based on credit and payment history, and they may vary at any moment and without prior notice at Kolaxo Instrument’s sole discretion. This transaction is governed by the payment terms stated on this invoice. Every payment must be made in US dollars.
Kolxo Instrments is not accountable for special, incidental, direct, indirect, or consequential damages arising from breach of contract, breach of warranty, negligence, or any legal theory Such damages may include, but are not limited to, lost earnings or revenues, loss of use of the product or any related equipment, cost of capital, cost of any substitute product, facility, or service, costs associated with downtime, lost reputation, or claims of such damages from customers.
